WhatsApp Messenger

Unacceptable harassment
Sharing messages using the WhatsApp sharing button could potentially constitute a violation of Section 7(2)(3) of the German Unfair Competition Act (UWG). This would require electronic mail to be sent to individual recipients without their prior express consent. According to Section 7 (2) No. 3 BDSG, "electronic mail" is defined as any text, voice, sound, or image message sent via a public communications network that can be stored on the network or on the recipient's terminal device until it is retrieved by the recipient. Sending such a message would therefore be inadmissible as unreasonable harassment.


Use of videos (e.g., YouTube, Vimeo)
